1. Agreement to Terms

  • Misuse, modification, tampering, or unauthorized alteration of any equipment is strictly prohibited.

  • Users are solely responsible for ensuring proper training, competence, and safe operation of equipment.

5. Sales, Orders, and Returns

Equipment Leader offers sales, rentals, and repair facilitation under conditions disclosed at the time of transaction.

Returns & Refunds

All returns, refunds, final-sale classifications, inspection requirements, and return windows are governed exclusively by our Returns & Refund Policy, which is incorporated into these Terms by reference and available at:

6. Rentals and Rental Agreements

  • All rental transactions are governed by a separate rental agreement provided at the time of rental.

  • Customers must review and accept the rental agreement prior to taking possession of equipment.

  • The rental agreement governs liability, damage, loss, maintenance, insurance, fees, and return conditions.

  • These Terms supplement, but do not replace, the rental agreement.

7. Repairs and Third-Party Service Providers

  • Repair services may be performed by independent third-party providers.

  • Equipment Leader does not perform repairs unless explicitly stated in writing.

  • Equipment Leader is not responsible for damages, delays, workmanship, or outcomes resulting from third-party repair services.

  • Customers must review and agree to the specific repair contract provided at the time of engagement.

8. Third-Party Equipment Listings and Consignments

  • Equipment listed or consigned by third parties is governed by separate listing or consignment agreements.

  • Owners are responsible for reviewing their agreements, which define rights, responsibilities, fees, liabilities, and terms.

  • Equipment Leader does not guarantee the performance, condition, or suitability of third-party listed equipment unless expressly stated.

9. Pricing, Payments, and Chargebacks

  • All prices are listed in U.S. dollars unless otherwise stated.

  • Customers agree not to initiate chargebacks except where legally permitted.

  • Fraudulent or abusive chargebacks may result in account suspension, collection actions, and recovery of associated costs.

  • Equipment Leader reserves all legal remedies related to improper chargebacks.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Equipment Leader shall not be liable for indirect, incidental, consequential, special, or punitive damages.

  • Equipment Leader is not responsible for injuries, losses, or damages arising from:

    • Improper or unsafe equipment use

    • Failure to follow instructions

    • User negligence

    • Third-party services or actions

Users assume all risks associated with the use of equipment and Services.

11. Assumption of Risk & Indemnification

You agree to:

  • Assume all risks related to equipment use and Services

  • Indemnify and hold harmless Equipment Leader, its officers, employees, agents, and affiliates from claims, damages, losses, liabilities, or expenses arising from:

    • Your use of the Services

    • Your violation of these Terms

    • Your violation of applicable laws or third-party rights

12. Intellectual Property & Copyright

  • All content on Equipment Leader platforms (logos, text, designs, layouts) is owned by or licensed to Equipment Leader unless otherwise stated.

  • Photos, images, or media may be copyrighted by third parties.

  • Unauthorized copying, reproduction, distribution, or use of copyrighted materials is strictly prohibited.

13. DMCA Compliance

Equipment Leader complies with the Digital Millennium Copyright Act (DMCA).
